A. DRIVERS LICENSE LAW

In order to be eligible for driving privileges, a student must satisfy one of the following criteria:

Ø      Be enrolled in school and satisfy the district's attendance policy

Ø      Have a high school diploma or equivalent

Ø      Be enrolled in a study course in preparation for GED and satisfy the attendance policy

Ø      Be enrolled in other educational activities approved by the school board and satisfy the attendance policy

Ø      Have received a hardship waiver

 

Following notification that a minor fails to comply with attendance requirements, the Florida DMV may not issue a driver's or learner's license to or must suspend the license of a minor.

 

The Florida DMV must notify the minor and the minor's parent or guardian of the intent to suspend driving privileges.

 

Following date of receipt of notification to suspend, the minor or a parent has 15 calendar days to provide proof of compliance.

 

The minor or parent or guardian has 15 calendar days to request a hardship waiver hearing before the public school principal. The hearing must be conducted within 30 calendar days of the request.

 

If denied, the student may appeal to the school board for a waiver hearing. This hearing must be conducted 30 calendar days after receiving the request.

 

Each principal or administrator is to notify the superintendent (school board) of each student who accumulates fifteen (15) unexcused absences within 90-calendar days.

 

Each superintendent MUST report the name, sex, date of birth, and social security number to the Florida DMV.

 

 

 

 

 

B. STUDENT DRIVER POLICIES AND PROCEDURES

Driving a car to and from the center is to be considered a privilege, one that can be revoked if the student does not meet certain conditions and responsibilities. 

 

The following are regulation that must be adhered to if driving privileges are to be granted:

 

1.     Student must possess an operator’s driving license.  Restricted license and/or learner’s permits are not acceptable.

2.     Vehicle registration and proof of the student’s insurance coverage must be submitted to the center.

3.     Students may not leave the center’s campus during center hours without written and verbal parental permission. 

4.     Student driver may not be permitted to transport other students on or off the campus without administrative and parental consent.

 

Other policies may be implemented as future conditions and situations warrant.
